Permanent Residence on Humanitarian and Compassionate Grounds
The IRPA allows applying for permanent residence on humanitarian and compassionate grounds.
The Immigration and Refugee Protection Act (IRPA) allows foreign nationals who are inadmissible or who are not entitled to apply under an immigration category to apply for permanent residence or an exemption from a legal requirement on humanitarian and compassionate grounds.
You may be eligible if you:
- are currently in Canada; and
- need an exemption from one or more requirements of the IRPA or its Regulations (IRPR) to obtain permanent residence in Canada;
- believe your situation justifies humanitarian and compassionate consideration for the required exemptions; and
- are not eligible to apply for permanent residence under one of the following categories: spouses or common-law partners, economic class, protected persons and Convention refugees, holders of a temporary resident permit.
